GENERAL CONTRACT CONDITIONS
The General Conditions of Contract contained in this document are applicable to all commercial transactions carried out through the website. www.balbas.es whose owner is Bodegas Balbás, SL with Registered Office at Calle La Majada s/n, 09311 La Horra (Burgos) and CIF B09107046, contact telephone number 947 542111 and email firstname.lastname@example.org
2. ACCEPTANCE OF THE CONDITIONS
By accepting these General Conditions, the User states:
- That you have read and understood what is stated here.
- That you are of legal age in accordance with the regulations in force in your place of residence; Otherwise, the minor must have the authorization of their legal representatives.
- That, in the event that it is ready to contract a product and/or service, it has sufficient capacity to do so.
- That he assumes all the obligations set forth herein.
The User must carefully read these General Conditions each time they access the Website, since the same and these General Conditions may be modified.
The owner of the Website reserves the right to make, at any time, any modification or update of its contents and services, of these General Conditions and, in general, of all the elements that make up the design and configuration of the Website.
The modification of these General Conditions will not affect the goods or promotions that had been acquired prior to said modification.
3. USER REGISTRATION
The use of the services provided by Bodegas Balbás implies the need for the User to register on the Website.
The User must proceed to register indicating their full name and email address.
Once the User is correctly registered on the website, they can access "My Account" at any time. Through "My Account" the User can modify their personal data, as well as the data related to their orders.
4. SELECTION OF PRODUCTS BY THE USER
Any registered User may contract the purchase of products through the Website.
The purchase process at Bodegas Balbás is based on a virtual basket, to which the User can add the products they wish to purchase.
To add products to the shopping cart, once the user is on the product description page and has selected the available customization options, they must select the "Add to cart" option provided.
At any time the User can access and modify the content of the basket.
5. ORDER PROCESSING
Once the products you wish to purchase are in the shopping cart, the User can start processing the order by selecting the "View cart" option, an option that will show the User the content of the virtual cart, allowing the modification of the selected products and their removal from the shopping cart.
The User must ensure that the products indicated on the screen are the ones they wish to purchase. At this point the total price of the selected products and the shipping costs generated are displayed.
By pressing "next", the User accesses a panel where they must indicate the shipping data; To continue with the contracting process, the User must fill in the shipping information, including their full name, telephone number and address, filling in all the fields marked as mandatory.
If the User wants the billing address to be different from the shipping address, they must check the box "My billing address is different from the delivery address" and fill in the corresponding information.
In the next phase of the purchase process, the User must select the payment method. At this time, the User is again informed of the exact amount to pay, resulting from adding the price of the products and the shipping costs.
Following the link “Place the order”, the User will be taken to the selected payment gateway. Once the payment has been processed correctly, the order will be processed automatically.
6. CONFIRMATION OF RECEIPT OF ACCEPTANCE
Once the purchase process is completed, the User will receive, at the email address designated in the registration form, a communication specifying the characteristics of the product, price, selected shipping method, contract date and order number.
7. PRICE OF THE PRODUCTS
The prices of the products are those indicated in the description attached to them. All prices indicated in the product description are expressed in the Euro currency (€) and include Value Added Tax (VAT).
8. METHOD OF PAYMENT
The purchase of products through the Bodegas Balbás online store allows the following forms of payment:
Payment by debit or credit card (VISA, MASTERCARD AND AMERICAN EXPRESS) through a virtual POS.
By Bank transfer.
Bodegas Balbás does not have access to the bank data linked to the means of payment and does not know or record this data during the payment operation.
9. SHIPPING CONDITIONS
Bodegas Balbás, through the Website, only sends its products to Spain (Peninsula and Balearic Islands). For other destinations, Bodegas Balbás will be contacted through the email address email@example.com or by calling 947.542.111.
The purchase of products on the Website is subject to the payment of shipping costs, on behalf of the buyer, (they will depend on the number of products purchased as referred to in the texts of the Store itself), being free from 100.00 € of order.
In any case, the effective shipping costs will be detailed throughout the purchase process and the buyer will have the opportunity to review these costs before finalizing their purchase. Bodegas Balbás cannot be held responsible for delays in the delivery of orders for reasons not directly attributable to Bodegas Balbás, acts of God or force majeure.
The shipping costs mentioned include, in addition to the transport of the products, their packaging in boxes specially designed to transport bottles, insurance against loss or breakage, as well as VAT.
The delivery of the orders will be made at the delivery address freely designated by the User. Bodegas Balbás will not assume any responsibility when the delivery of the product does not take place as a result of the inaccuracy or falsity of the data provided by the User for this purpose, as well as in the event that the delivery cannot be made for reasons beyond its control. Bodegas Balbás, such as the absence of the recipient at the delivery address.
In case of absence of the recipient and whenever possible, a passing note will be left with the necessary information to agree on a new delivery at the address of the recipient or the necessary instructions for the latter to pick up the product at a certain place. In any case, after 7 days from the last delivery attempt without the order being able to be delivered, it will be returned to origin and the contract will be terminated.
10. DELIVERY ERROR
Upon receipt of the order, the User must verify that the products delivered coincide with those of the order placed, otherwise the procedure will be as follows:
YO. If the products coincide with those reflected on the delivery note, but not with those of the order placed and confirmed by Bodegas Balbás:
The User will have a maximum period of fourteen (14) calendar days from receipt of the order to notify the incident to Bodegas Balbás via email. firstname.lastname@example.org or by phone at 94542111, indicating your personal data and order number.
After this period, it will be understood that the delivery is accepted and compliant. If the value of the merchandise delivered is higher than that of the order placed, Bodegas Balbás will proceed to claim the difference in amount, taking, if necessary, the pertinent legal actions.
II. If the products delivered do not match those reflected on the delivery note:
The User must reflect the incident expressly on the carrier's delivery note and immediately contact Bodegas Balbás via email. email@example.com or by phone at 947542111, indicating your personal data and order number.
Once the relevant notification has been received, Bodegas Balbás will contact the User again, within a maximum period of 48 working hours, in order to manage the removal and/or replacement of the products as soon as possible.
III. Breakage or serious damage:
At the time of delivery of the order to the User by the carrier, the carrier must check that the packaging is not deteriorated or damaged to such an extent that it may have affected the content. If so, the user must proceed as follows:
The User must verify in the presence of the carrier the integrity of the products delivered. In the event of breakage or serious damage to part or all of the products, you must reflect this on the delivery note and immediately contact Bodegas Balbás via email. firstname.lastname@example.org indicating your personal data, the order number and broken or damaged products.
Once the incident has been notified, Bodegas Balbás will proceed to replace all the affected products as soon as possible, always within fifteen (15) calendar days, and at no additional cost to the User.
11. RETURNS AND CANCELLATIONS
Right of Withdrawal
In any case, the buyer will have a period of fourteen (14) calendar days after receipt of the Product to exercise their right of withdrawal without having to justify reasons or face any penalty.
In accordance with article 102.d) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, not being applicable the supply of goods that can deteriorate or expire quickly, so that the right of withdrawal cannot be exercised on bottles that have been opened, for example, due to the rapid deterioration of the content in such cases.
The buyer must express his intention to withdraw within the indicated period and must proceed to return the product. To exercise your right of withdrawal, you can contact us using the contact information that appears in the purchase cancellation section.
The reimbursement period is 14 calendar days from the notification of withdrawal, although this will only be done once the items have been received and it has been verified that the User has not carried out any manipulation other than that necessary to establish the nature, characteristics and operation of the items.
If the payment was made by bank card, the refund will be made on the same card.
Cancellation of Purchases
The user can cancel the purchase process as long as it has not been processed in its entirety. In order to ensure said cancellation by the client, it is advisable to contact Bodegas Balbás immediately, by email. email@example.com or by phone at 947542111.
12. NULLITY AND INEFFECTIVENESS OF THE CLAUSES
If any clause included in these General Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part of it that is null or ineffective, subsisting these General Conditions in everything else. , considering such provision totally or partially as not included.
13. APPLICABLE LEGISLATION AND COMPETENT JURISDICTION
These General Conditions will be governed and interpreted in accordance with Spanish law. Bodegas Balbás and the User agree to submit any dispute that may arise from the provision of the products or services covered by these General Conditions, to the Courts and Tribunals corresponding to the User's domicile, except in the event that the buyer's domicile is outside of Spain, in which both parties will submit to the Courts and Tribunals of Burgos (Spain).
